(ORAL) Present appeal emanates from the order passed by Guardian Judge, Fatehgarh Sahib under section 25 of the Guardian & Wards Act, 1890 whereby custody of minor child namely Abhijot Singh was handed-over to the mother of the respondent. Husband-Manpreet Singh has preferred instant appeal before this court. During pendency of the appeal, matter was referred to Mediation and Conciliation Centre. It has been decided before the said Forum that custody of minor child-Abhijot Singh shall be retained by the mother. Under the circumstances, no cause of action survives in this appeal. However, counsel for the respondent points out that appellant-husband has to clear the arrears as regards maintenance for the child. Learned counsel for the appellant submits that all pending arrears shall be cleared in terms of the settlement within one month from today.
