**** SANJAY VASHISTH , J. (Oral) Order dated 27.09.2022, says as under:- "Learned counsel for the petitioner submits that on the one hand her husband - Gurdev Singh has been implicated in a case under Section 307 IPC and on the other hand petitioner is apprehensive of some untoward incident such as kidnapping of her 10 years old daughter because at the instance of private respondents some unknown persons have been moving around the house of the petitioner. Learned counsel further contends that houses of the petitioner and private respondents are facing each other.
At this stage, without issuing formal notice of motion, Mr. J.S. Arora, Deputy Advocate General, Punjab, who is present in the Court, is directed to file a detailed status report in the matter on or before the next date of hearing. Complete copy of the paper book shall be supplied to him by learned counsel for the petitioner during course of the day.
Adjourned to 02.11.2022."
Therefore, status report dated 10.12.2022, was filed by respondents No.1 to 4, and para Nos. 6 to 8, of said status report says as JAWALA RAM 2023.01.10 15:19 I attest to the accuracy and authenticity of this order/judgement.
CRWP-9264-2022 - 2 - under:- "6) That said application was entrusted by Commissioner of Police Jalandhar to answering respondent and answering respondent further entrusted the enquiry to SHO P.S. Division No.5 Jalandhar and upon enquiry it transpired that petitioner has earlier filed complaint bearing no.130-Peshi Dated 13-04-2022 before Commissioner of Police Jalandhar on the similar facts an of present complaint and said complaint was closed after due enquiry.
7) That after enquiry into present complaint it further transpired that in order to create defence in the case FIR(SUPRA) petitioner has filed present complaint just to put pressure on respondent no.5 so that compromise can be effected in FIR (supra) registered by respondent no.5 against husband of petitioner and petitioner has filed present application just to harass the respondent no.5 and his family members as such it was recommended to close the complaint filed by petitioner. 8) That thereafter SHOPS. Division No.5 vide his report dated 5-11-2022 Recommended to close the complaint filed by petitioner and sent his report to answering respondent and answering respondent, thereafter answering respondent approved the same and forwarded his report to DCP Investigation Jalandhar who approved the same and thereafter Commissioner of Police closed the said complaint."
Faced with the situation, counsel for the petitioner seeks withdrawal of present petition with liberty to avail other alternative remedy, as may be available to her, under the law.
