Mr. S.K.Rana, Advocate for respondent No.1(b) *** AJAY TEWARI, J.(oral) This appeal has been filed against the concurrent judgments of the Courts below decreeing the suit filed by the respondent No.1-deceased whereby he had challenged the promotion given to the appellant. The claim of the plaintiff was that the daily wage/adhoc service of the appellant had wrongly been added in his regular service and consequently he had illegally been made senior to him. Both the Courts below held that the period of daily wage/ad hoc service could be counted for giving retiral benefit but could not be counted for seniority. Learned counsel for the appellant is not able to show me how these findings are flawed.

Consequently, the appeal stands dismissed.
