(ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular to the petitioner in case FIR No. 62 dated 05.08.2020 (Annexure P-1) registered under Sections 363/366-A IPC at Police Station Sadiq, District Faridkot, after amendment of charge under Section 376 IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012, by the trial Court vide order dated 10.08.2023 (Annexure P-2).

Learned counsel for the State has filed custody certificate dated 09.09.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 06 months and 06 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
