(ORAL) Prayer in this second petition filed under Section 439 Cr.P.C. is for grant of regular to the petitioner in case FIR No. 122 dated 21.07.2021 registered under Sections 304-B and 302 IPC (added vide GDR No. 24 dated 26.09.2021) at Police Station Kabarwala, District Sri Muktsar Sahib, Punjab.

Learned counsel for the State has filed custody certificate dated 02.09.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 02 years, 01 month and 08 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.
