The instant writ petition has been filed challenging the 'Eauction' conducted by the respondent-Bank of the mortgaged property comprising residential House No.254, Sector 16A, Faridabad. The auction was admittedly scheduled and has been held on 28.03.2018. The only plea taken by the petitioner-borrowers is that they have got a willing buyer to pay the reserve price of the house directly to the lender-Bank. This petition, in the light of subsequent event, namely, that the auction has been held, has become infructuous. The writ petition is accordingly disposed of with liberty to the petitioners to file a fresh petition challenging the auction dated 28.03.2018 before an appropriate Forum in accordance with law.
