**** RAJ MOHAN SINGH, J.(Oral) CMM No.150 of 2019 Unsuccessful husband-appellant in HMA No.95 dated 31.07.2012 has preferred the present appeal against the judgment and decree dated 02.12.2013, vide which the petition under Section 13 of the Hindu Marriage Act was dismissed. After issuance of notice of motion, both the parties have appeared through their respective counsel. Both the parties are ad idem that they are living together for more than 2 years. Learned counsel for the appellant on instructions from the appellant submits that he does not wish to carry on with the present appeal and this appeal be dismissed as withdrawn. The respondent-wife is also present along with her counsel. Learned counsel for the respondent has no objection to the aforesaid course.

In view of aforesaid, the main case is taken up today itself.
