**** RAJAN GUPTA, J. (Oral) Counsel for the appellant at the outset points out that the parties have entered in to a compromise during pending of the instant appeal. The court has also been apprised that the parties intend to move the appropriate Forum for dissolution of marriage by way of mutual consent by invoking Section 13-B of the Hindu Marriage Act, 1955 (in short 'the Act'). A petition shall be filed on mutually acceptable terms. This contention is not controverted by the counsel for the respondent.
Counsel for the appellant submits that he may be allowed to withdraw the instant appeal with liberty to file a fresh petition under Section 13-B of the Act before the competent court of law.
Dismissed as withdrawn with liberty as aforesaid. Needless to observe that parties shall be at liberty to seek waiver of the statutory period of six months in terms of the judgment of the Apex Court rendered in Amardeep Singh Vs. Harveen Kaur, 2017(4) R.C.R. (Civil) 608.
