2.

Learned counsel contends that the petitioner is in custody for 1 year and more than 2 months. The allegations against the petitioner are of having given kick and fist blows to the deceased while the fatal injury has been attributed to co-accused Lakhvir Singh, who is behind bars. Coaccused Ram Singh, who was also attributed blows besides lalkara, has been granted regular bail by this Court vide order dated 03.08.2023, Annexure P-4. Charges were framed on 22.05.2023 and only 6 out of 24 witnesses have been examined, including the complainant. The petitioner is not involved in any other case.

3.

The custody certificate dated 03.09.2023, filed by learned State counsel is taken on record, as per which, the petitioner is behind bars for 1 year, 2 months and 4 days.

4.

Learned State counsel opposes the bail on the ground that the there are specific allegations the petitioner of having given kick and fist blows to the deceased. He is however unable to controvert the submissions made regarding the stage of the trial, petitioner not being involved in any other case and co-accused has been granted bail. 5.
