The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to renew his passport.

Learned counsel for the petitioner inter alia submits that respondent No. 2 has not issued passport on the ground that an FIR is pending against the petitioner whereas no FIR is pending against the petitioner. There was an FIR No. 83 dated 23.03.2001 under Sections 307 and 341 of IPC and Sections 25/54/59 of Arms Act, registered against brother of the petitioner at Police Station, Sadar Thanesar, District Kurukshetra (Haryana), who was later on acquitted and he has passed away. Learned counsel for Union of India submits that petitioner may be directed to appear before passport authority alongwith requisite documents so that position with respect to afore-stated FIR may be clarified. 4.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

The petitioner is directed to appear before passport authority on 25.09.2023 alongwith all documents relating to afore-stated FIR. On doing so, passport authority shall pass an appropriate order within six weeks thereafter.
