Present petition under Article 226/227 of the Constitution of India for issuance of directions to the respondents to appoint the petitioner against the vacant post of Lecturer (Pharmacy), lying vacant for SC (sports) category as no candidate under the said category was available. Learned counsel for the petitioner contended that petitioner belongs to Balmiki category which falls under Scheduled Caste and as no person is available from SC (sports) category, he has to be considered for the said post, otherwise he is at serial No.6 in the final merit list of Balmiki/Mazhabi Sikh. For that purpose, petitioner has already made representations (Annexures P4 to P6), respectively, to the Government of Punjab, which are still pending. Learned counsel further contended that petitioner would be satisfied if his representation (Annexure P4) is decided by the Government of Punjab by passing a speaking order. Civil Writ Petition No. 8152 of 2018 In view of above, present petition is disposed of with the directions that representation (Annexure P4), made by the petitioner, be decided by respondent No.3-Additional Chief Secretary, Department of Technical Education and Industrial Training within a period of two months from the date of receipt of a certified copy of this order, as per instructions already available on the point and issued by the Punjab State, which are Annexure P7 on the file.
