By virtue of instant petition preferred under Article 226/227 of the Constitution of India, the petitioners have sought issuance of a writ particularly in the nature of mandamus directing the respondents to pay arrears of difference of pay after restoring 4 special increments in accordance with the judgment of this Court in LPA No. 1161 of 2009 (P-8) as modified by the Hon'ble Supreme Court of India in SLP (C) 13027 of 2011 as decided on 16.07.2014 (P-9) and further as generalized by this Court vide judgment dated 28.04.2016 in CWP25992 of 2015 (P-10) with interest @ 18% p.a. and also to calculate and pay the retiral dues accordingly.

At the very outset of the arguments, learned counsel for the petitioners submits that though representation dated 04.04.2017 (Annexure P-11) was moved to the respondents but till date neither any Sonika 2018.04.04 17:20 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.8154 OF 2018 --2-- response has been received nor any conscious decision has been taken thereon. He submits that petitioners feel satisfied in case direction is issued to respondent No.2 to decide aforesaid representation within a stipulated period. 3.

Without expressing any opinion on the merits of the case, instant petition is disposed of with the direction to respondent No.2-Chief Engineer, Ranjit Sagar Dam, Shahpurkandi Township, Tehsil and District Pathankot to look into the grievances unfolded by the petitioners in representation dated 04.04.2017 (Annexure P-11) and to decide the same strictly in accordance with the judgments already referred to in the aforesaid representation, within a period of three months from the date of receipt of certified copy of this order. 4.

However, if the petitioners still feel aggrieved against the order passed by the respondents, they shall be at liberty to have recourse to the other remedies available under law as well as to approach this Court.
