Counsel for the appellant submits that appellant Raj Rani has died.
We adverted to the question whether anything survives for prosecution by the legal representatives of the appellant on her demise. We find that Raj Rani in fact filed the petition under Section 13 of the Hindu Marriage Act seeking divorce from the respondent husband on the ground of cruelty and desertion but the same was dismissed and, therefore, she has preferred the present appeal.
Under such circumstances, we are of the view that nothing survives for her legal representatives to agitate before the Appellate Court. Appeal abates.
