The present contempt petition has been filed for deliberate and intentional disobedience of order dated 19.04.2024 passed by this Court in CWP-15974-2021.

This Court had issued the following directions in CWP-159742021, vide its order dated 19.04.2024:- "17. In view of the aforesaid facts and circumstances, the present petition is allowed. Order dated 07.06.2021 (Annexure R-1) is hereby set aside. The respondentsNigam are directed to refund the entire amount of Rs.5,75,564 to the petitioner alongwith the interest @ 6% per annum (simple) from the date of his retirement till its actual disbursement within a period of three months from today. In case the aforesaid amount is not paid to the petitioner within the stipulated time frame then the

-2petitioner shall be entitled for future rate of interest @9% per annum (simple).

In the facts and circumstances of the present case whereby the Chief Engineer, UHBVN, Panchkula, has illegally issued a show cause notice to the petitioner and thereafter passed a punishment order with a predetermined mind as aforesaid, the petitioner shall also be entitled for costs which are assessed as Rs.25,000/- (Rupees Twenty Five Thousand only) and the same shall be paid by the respondents-Nigam within a period of three months from today at the first instance and thereafter the respondents-Nigam shall recover the aforesaid amount of costs from the Chief Engineer, who issued the aforesaid show cause notice with a predetermined mind." 3.

In compliance of the order dated 19.04.2024 passed by this Court in CWP-15974-2021, compliance report by way of affidavit dated 12.09.2025 of Sh. Pardeep Kumar, XEN OP Division, UHBVN Pundri, Kaithal, has been filed on behalf of the respondents before the Registry. The same is taken on record. The relevant portion of the said compliance report is reproduced as under:- "4.

That the matter came up for hearing on 02.09.2025, where the counsel for the petitioner argued that the order dated 19.04.2024 passed in CP 15974 of 2021 has not been complied with in toto and the services rendered by the petitioner on daily wage basis has not been counted for the purpose of pensionary benefits and re-fixation of pension and retiral benefits have not been given to the petitioner 5.

That it is respectfully submitted that in compliance of the order dated 19.04.2024, the answering respondents have issued the office order no. 43 dated 17.03.2025 and the service rendered by the petitioner on daily wage basis is counted towards pensionary and retiral benefits. Copy of office order no. 43 dated 17.03.2025 is annexed as Annexure R-1.

That it is further submitted that the revised PPO along with payment of DCRG/Gratuity has been released to the petitioner vide GPO No.14324 UHBVNL/PEN 14448 dated 17.03.2025. The payment of Rs.113120 towards DCRG/Gratuity has been released to the petitioner through cheque no. 024497 dated 18.03.2025. Copy of GPO No.14324 UHBVNL/PEN 14448 dated 17.03.2025 along with copy of cheque no. 024497 is annexed as Annexure R-2."

Learned counsel for the respondents submits that the order dated 19.04.2024 passed by this Court in CWP-15974-2021 has been complied with, which is not disputed by learned counsel for the petitioner. 5.

In view of the above, since order dated 19.04.2024 passed by this Court in CWP-15974-2021, has already been complied with, therefore, the present contempt is purged and rule stands discharged. 6.
