*** HARSIMRAN SINGH SETHI , J. (ORAL) As per the averments made in the present writ petition, the petitioner was hospitalized and was being treated in the Artemis Hospital, Sector 51, Gurgaon and he remained admitted there from 18.01.2018 till 07.02.2018.

Counsel for the petitioner argues that petitioner incurred a total sum of `4,04,906/- during the said period of treatment, for which he raised a claim for the reimbursement. Counsel further argues out of the total sum of `4,04,906/- only a sum of `1,68,548/- has been reimbursed to the petitioner, whereas a sum of `2,36,357/- has not been released so far. Counsel for the petitioner further argues that as Artemis Hospital, Sector 51, Gurgaon was on the panel under the policy, petitioner was entitled for the full reimbursement. CWP-25204-2019 -2petitioner prays that a direction needs to be issued to the respondents to release the remaining amount of the medical reimbursement to the petitioner.

Counsel for the petitioner states that for the relief which has been sought in the present writ petition, petitioner has served the respondents with a legal notice dated 08.04.2019 (Annexure P-5), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 08.04.2019 (Annexure P-5) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of three months thereafter.

Present writ petition stands disposed of.
