(Oral) The present petition has been filed under Section 482 Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking anticipatory bail in FIR No.279 dated 28.05.2025 (Annexure P-1) under Sections 115(2), 190, 191(3), 351(2) and later on added 304, 308(2) of BNS registered at Police Station Krishna Gate, District Kurukshetra.

The case of the prosecution is that the complainant runs a cycle stand in the parking of Railway Road, Kurukshetra. On 26.05.2025 at about 11.15 pm, one Cheenu Taal wala alongwith the present petitioner and some unknown persons came there and asked the complainant to give them 'monthly'. However, upon refusing, the petitioner alongwith his co-accused gave beatings with stick, broom, chairs and caused injury to the complainant by striking empty beer bottle on his head.

Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case by the complainant. Moreover, there is a delay of 02 days in lodging of the FIR.

On the other hand, learned counsel for the State opposes the grant of bail on the ground that the allegations made against the petitioner are grave in nature and prays for dismissal of the anticipatory bail. 5.

I have heard learned counsel for both the parties and have considered the allegations against the petitioner. Although the petitioner has not been attributed any injury, however, allegations are serious as they were collecting "monthly" from innocent persons and as such, he does not deserve the concession of anticipatory bail.

In view of above, no ground is made out to grant the concession of anticipatory bail to the petitioner. Therefore, the present petition stands dismissed.
