Prayer is for grant of anticipatory bail in FIR No.68 dated 15.05.2023, registered under Sections 341, 323, 427, 379-B, 506, 353, 186, 148 and 149 of IPC, 1860, registered at Police Station Mamdot, District Ferozepur.

Learned counsel for the petitioner has submitted that the petitioner has joined the investigation.

Learned State counsel on instructions from HC Kanwaljit Singh has submitted that the petitioner is not cooperating in the investigation.

At this stage, learned counsel for the petitioner has placed on record the vernacular of the General Diary Details, wherein it has been stated that the petitioner has joined the investigation and his custodial interrogation is not required.

In view of above, the petition is allowed. The order dated Manju 2024.03.22 17:13 I attest to the accuracy and integrity of this document

2024:PHHC:041524 CRM-M-43968-2023 04.09.2023 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.

However, nothing stated above shall be construed as a final expression of opinion on the merits of the case and this order shall not be construed as parity qua any other co-accused. 7.

It is made clear that, in case, the petitioners are found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
