HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA Present:- Mr. Sandeep Thakan, Advocate, for the petitioner. Ms. Tanushree Gupta, Deputy Advocate General, Haryana. The petition has been filed, inter alia, seeking a writ of certiorari quashing the transfer order, dated 16.08.2024, Annexure P-2, passed by the second respondent, whereby the petitioner has been transferred from the office of 16 Har BN NCC, Narnaul to 4 Har Girls BN NCC, Nuh. It is contended that the order is in violation of Clause 3 (c) of Transfer Policy, dated 13.02.2020, Annexure P-3. And is against the Principles of Natural Justice also.

Learned State counsel, on instructions, contends that the Policy, dated 13.02.2020, is not applicable in the petitioner's case, as the transfers are regulated by Online Transfer Policy for NCC cadre, dated 09.12.2021, issued by the Principal Secretary to Government of Haryana, Higher Education Department. The petitioner was transferred on administrative grounds in terms of Clause 13 of the Policy with prior approval of the Chief Minister, in relaxation of the provisions. 3.

In view thereof, it is apparent that the order of transfer has been issued in terms of the Policy by taking requisite administrative approvals AVIN KUMAR 2024.08.29 09:27 I attest to the accuracy and integrity of this judgment/order.

CWP No.20367 of 2024 [2] for which the process was initiated prior to 16.08.2024, the date schedule for State Assembly Elections was announced.

Accordingly, no ground to interfere with the impugned order is made out.
