H. S. Madaan, J. (Oral) Petitioner - Jagmohinder Singh, working as Head Draftsman in the office of Executive Engineer, HSAMB, Rohtak, by way of filing the present writ petition, seeks issuance of a direction to the respondents - State of Haryana through its Additional Chief Secretary, Agriculture and Farmer Welfare Department, Haryana civil Secretariat, Chandigarh; Haryana State Agricultural Marketing Board, Sector 6, Panchkula, Haryana through its Chief Administrator; Engineer -in-Chief, Haryana State Agricultural Marketing Board, Sector 6, District Panchkula, Haryana and Executive Engineer

CWP No. 24642 of 2021 -2- (Civil), Haryana State Agricultural Marketing Board (HSAMB), Old Chara Mandi, Near Railway Station, District Rohtak, Haryana, to consider him for promotion as Circle Head Draftsman, in 3% quota reserved for Disabled persons vide Government of Haryana notification dated 17.4.2017, copy Annexure P-4. According to the petitioner, he had submitted representation Annexure P-5 to the Executive Engineer, Haryana State Agriculture Marketing Board, Rohtak - respondent No.4, dated 9.5.2019, but it has not evoked any response, as such he has been compelled to file the present writ petition.

Learned State counsel, who has been asked to assist the Court in the matter, has stated that case of the petitioner is not covered by the Rules. However, I find that it would be proper and appropriate if a detailed order with respect to the representation submitted by the petitioner is passed.

Accordingly, in order to enable the respondents to consider the claim of the petitioner and then to take appropriate action, if need be and to avoid unnecessary litigation, the present writ petition is disposed of directing respondents No.2 and 4 to consider the representation dated 9.5.2019 (Annexure P-5) submitted by the petitioner, as per law, rules, regulations and instructions on the subject and if some action in the matter is warranted, then the needful be done in accordance with law, within a period of two months from the date of receipt of copy of this order. A speaking order in that regard be passed, copy of which be sent to the petitioner as per

CWP No. 24642 of 2021 -3registered AD Post. It is observed that in case the petitioner still feels dissatisfied after disposal of his representation, then he may approach the Court again in accordance with law for redressal of his grievances.
