The only point of law that arises for consideration is whether the plaintiff who filed a suit for declaration on the ground that he had prescribed tile by adverse possession could maintain such an action. On reference made to the Division Bench from this Court in Vijay Bhwar and others Vs. Ajaib Singh (deceased) through legal heirs in R.S.A. No.2561 of 1985, it has been held that the plaintiff cannot maintain such an action. The point which is raised in the second appeal on the basis of which the plaintiff sought for decree and obtained decree, later reversed in appeal stands fully answered by the Division Bench and there is nothing further to be done now. 2.

The second appeal is dismissed.
