The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to respondents No.2 and 3 to release his passport.

Learned counsel for the petitioner inter alia contends that the police officials posted at Police Station Sadar Sirsa have seized passport of the petitioner. The passport was seized by police officials in 2018 and despite repeated requests, till date, has not been released. Relying upon judgment of Hon'ble Supreme Court in Suresh Nanda vs. CBI, (2008) 3 SCC 674, he submits that the police has no authority to seize passport and action of respondents amounts to misuse of power and abuse of process of law.
