The State is in appeal seeking reduction of compensation for the acquired land.

Briefly, the facts of the case are that State of Haryana vide notification dated 2.2.1999, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act') sought to acquire land measuring 16.89 acres situated in village Rohad, Hadbast No.25, Tehsil Bahadurgarh, District Jhajjar for four laning of National Highway No.10. The same was followed by notification dated 10.1.2000, issued under Section 6 of the Act. The Land Acquisition Collector (for short, 'the Collector'), vide his award dated 10.1.2002 assessed the market value of the acquired land @ ` 2,97,500/- per acre. Aggrieved against the award of the Collector, the landowners filed objections which were referred to the learned court below, who keeping in view the material placed on record by the parties, assessed the compensation for the acquired land @ ` 5,00,000/- per acre. This award has been impugned by the State in the present appeal.

Learned counsel for the State very fairly submitted that in view of the order passed by this Court in RFA No. 3046 of 2009- State of Haryana and others v. Partap, decided on 27.3.2014, whereby compensation SHARMILA 2015.09.21 17:10 I attest to the accuracy and authenticity of this document.

RFA No. 815 of 2012 (2) for the land acquired vide same notification was enhanced to ` 6,20,000/- per acre, nothing survives in the present appeal. Accordingly, for the reasons recorded in Partap 's (supra), the present appeal is dismissed. Consequently, the accompanying applications are also dismissed.
