Mr. Hitesh Pandit, Advocate for the petitioner. *** ANIL KSHETARPAL, J (Oral) The Government has directed the Executive Officer, Municipal Council, Morinda, to get a criminal case registered against the petitioner under the charges of misuse of power, depriving the rights of a person, belonging to the Scheduled Castes, committing fraud and cheating. The petitioner was a former Chairman of Municipal Council, Morinda. The petitioner claims that in an intra departmental inquiry he has been exonerated.

In the considered view of this Court, the first informant cannot be restrained from informing the police about the occurrence of an offence. The full form of FIR is First Information Report. Learned counsel representing the petitioner failed to draw the attention of the Court to any extraordinary circumstances which may help the Court to prima facie form an opinion that the information to the police, is result of any vendetta, against him. Hence, no ground to entertain the writ petition at this stage. Disposed of.
