RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for quashing of impugned Notice dated 21.08.2023, Annexure P-7, whereby the petitioner has been asked to vacate her personally owned residential house due to her alleged failure to discharge the outstanding liabilities of respondent No.5/Company, despite the fact that petitioner is not a Director or shareholder in the Company. At the outset, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to the petitioner to avail alternative remedy, as available to her, under the law. However, he has submitted that petitioner has been directed to vacate the premises. After hearing counsel for the petitioner, petition is dismissed as withdrawn with liberty aforesaid. However, it is directed that if petitioner files an appropriate petition before the concerned Authority within a period of ten days from today, the Authority concerned would decide the same expeditiously, in accordance with law.

CWP-19024-2023 -2In the meantime, status quo be maintained till expiry of ten days from today.

Needless to say that in case no petition is filed before the concerned authority within ten days from today, this order would be of no avail to the petitioner.
