Respondent Bachittar Singh filed a petition before the Additional District Judge, Hoshiarpur praying for dissolution of marriage on the ground of cruelty and desertion, invoking the provisions under Section 13 of the Hindu Marriage Act, 1955. The trial court after embarking upon the evidence adduced on either side was pleased to allow the petition for divorce filed by Bachittar Singh. Gurpreet Kaur, the wife of Bachittar Singh has challenged in the present appeal the divorce granted to respondent Bachittar Singh.

The matter was referred to Mediation and Conciliation Centre. Though appellant Gurpreet Kaur was not present, during such exercise embarked upon by the Mediation and Conciliation Centre, with the effective assistance of the brother of the appellant who was the power of attorney holder, the matter was effectively compromised between the PARVINDER SINGH 2016.04.23 12:47 I attest to the accuracy and authenticity of this document Chandigarh

FAO-M-292 of 2015 (O&M) parties. In fact, compromise agreement was entered into between the parties before the Mediation and Conciliation Centre. In terms thereof, appellant Gurpreet Kaur herself was required to sign the agreement of settlement and she also shall swear an affidavit. The above stipulation adumbrated in the agreement of settlement has been scrupulously complied with by the appellant. Respondent on his part, in terms of the agreement arrived between the parties paid a sum of `7 lacs in the shape of a bank draft towards permanent alimony and other claims to the counsel for the appellant who accepted the same.

In view of the above development in this case, counsel for the appellant seeks permission to withdraw the appeal. Permission is granted. Appeal stands dismissed as withdrawn.
