The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent No. 2 to issue his passport.

The petitioner applied for passport on 13.12.2022, however, his application has not been processed on the ground that an FIR is pending against him.

Learned counsel for the petitioner submits that an FIR No. 32 dated 23.01.2022, under Sections 419 and 420 of IPC was registered against the petitioner in Police Station, Indira Gandhi International Airport, New Delhi. The petitioner was arrested on 23.01.2022 and thereafter released on bail on 27.01.2023. The police after completing investigation filed its report PARAMJIT KAUR SAINI 2023.08.29 15:49 I attest to the accuracy and authenticity of this order/judgment

CWP No.19014 of 2023 -2- 2023:PHHC:112929 under Section 173 Cr.P.C. on 24.08.2022. The petitioner was extended benefit of Plea Bargaining and he was awarded sentence for the period already undergone. He was further subjected to fine of Rs. 2000/-, which he has already paid. The case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others, CWP No. 27167 of 2018  On being confronted with the aforesaid judgment, learned counsel for Union of India, who on advance notice is present in Court, submits that competent authority would pass an appropriate order within 8 weeks from today.

In the wake of statement of learned counsel for Union of India, the petition stands disposed of.
