Notice of motion.

On our asking, Mr.Gaurav Goel, Advocate, who is present in Court, accepts notice on behalf of the respondents. Let a copy of the petition be handed over to him during course of the day. The petitioners had availed 'Cash Credit Limit' of Rs.5.00 lacs from the respondent-Bank. They wanted to settle the loan account under the RINN Samadhan Scheme (One Time Settlement Policy) and the Bank has agreed to an offer of Rs.4,78,405/-. The petitioners honoured the commitment and deposited 10% of the settlement amount on 26.10.2017 followed by second deposit on 23.11.2017. They wanted to deposit the balance amount of Rs.2,85,272/- in two installments firstly on 05.03.2018 Meenu 2018.04.16 11:48 I attest to the accuracy and authenticity of this document chandigarh

CWP-8692-2018 -2and again on 15.03.2018. The Bank has returned both the deposits in their account. No information is being sent to the petitioners despite making request as to why the balance payment has not been accepted. [2] The action of the Bank prima facie is unfair unless there are valid reasons. We thus dispose of the writ petition with a direction to the respondents to adhere to 'RINN Samadhan Scheme', provided that there is no legal impediment and accept the balance payment as offered by the petitioners. However, in the event of any justifiable reason for nonacceptance thereof, a reasoned order be sent to the petitioners within two weeks. No coercive action shall be taken against the petitioners in the event of rejection of their proposed offer, for a period of three months so as to enable them to approach the appropriate Forum meanwhile.
