*** Ritu Bahri, J. (Oral) The present appeal has been filed against the judgment and decree dated 25.03.2015 passed by the learned Addl. District Judge, S.A.S. Nagar, Mohali, whereby petition filed by the respondent-husband under Section 13 of the Hindu Marriage Act, 1955 for dissolution of marriage, was allowed.
On 20.05.2022, this Court passed the following order:- "As per report of the Mediation and Conciliation Centre of this Court dated 17.05.2022, the parties have settled their dispute with the help of Ms. Rahish Pahwa, Mediator. As per compromise, the total amount of Rs. 13,25,000/- will be paid by the respondent-husband to the appellant-wife. List on 31.08.2022 to enable the respondentGAURAV ARORA 2022.09.30 15:32 I attest to the accuracy and integrity of this document Chandigarh
FAO-M-304-2015 husband to comply with the conditions of compromise deed dated 17.05.2022.
Today, statements of the parties have been recorded to the effect that the matter stands compromised between them. The respondent has handed over cheque bearing Nos. 010894 dated 29.08.2022 of Rs.5,00,000/- to the appellant, who was present in the Court. The appellant has stated that she has received the Rs.5 lacs and the remaining amount will be received by her on 30.11.2022 (Rs.5 lacs) and on 31.03.2023 (Rs.3,25,000/-). After receiving the entire amount, she will withdraw the cases filed by her against the respondent. Photocopy of the statement of the parties is taken on record as Annexure A-1 and A-2. In view of the above factual position, learned counsel for the appellant wishes to withdraw the appeal.
The appeal is dismissed as withdrawn. However, the parties will be bound by terms of the compromise dated 17.05.2022. Since the main appeal stands withdrawn, civil misc. applications, if any, shall also stand disposed of.
