Present appeal emanates from the order passed by Additional District Judge, Kaithal. Petitioner-Rajesh preferred a petition under section 13 of the Hindu Marriage Act for dissolution of marriage. All the allegations levelled by him were refuted by the appellant-wife. The court, however, came to the conclusion that petitioner-husband was entitled to divorce on the grounds stated in the petition. Admittedly, during the pendency of this appeal, a settlement has been arrived at between the parties. A copy thereof has been placed on record. Learned counsel state that parties intend to adhere to the terms of the compromise in letter and spirit. In view of above, learned counsel for the appellant submits that he may be allowed to withdraw this appeal with liberty to revive in case any condition of the settlement is not adhered to.
Dismissed as withdrawn with aforesaid liberty. Needless to observe that order passed by court below would have no relevance insofar it is superseded by the settlement which has been placed on record. (RAJAN GUPTA) JUDGE October 15, 2019 (MANJARI NEHRU KAUL) AJAY KUMAR 2019.10.
