Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No.67 dated 22.04.2019, under Section 306 IPC, registered at Police Station City-I Sangrur, District Sangrur.

FIR was lodged on the statement of Ram Singh wherein it was alleged that he was working in Holy Heart Convent School, Sangrur as a driver and has two sons and a daughter. In the year 2011, his son Parminder Singh was married to Sheenu d/o Sukhdev Singh and out of the said wedlock a son was born (Sabanpeet Singh). After divorce in 2016, his son entered into matrimonial alliance with Karamjit Kaur d/o Darshan Singh and from this marriage, a daughter was born. According to the complainant, for the past two months, his son was having relationship with Pooja d/o Gurdev Singh, who used to visit their house but later on she developed relationship with another person namely Kalu. CRM-M-38601-2019 (O & M) -2restrain his son from keeping relationship with her and Pooja also started disliking his son Parminder Singh. Distressed with this, the son of the complainant Parminder Singh committed suicide on 22.04.2019. Learned counsel for the petitioner contends that admittedly the victim was already married twice and had children, therefore, the reason given by the complainant behind the suicide of victim was not worth believing. According to him, petitioner cannot be attributed any abetment, as the victim was carrying on illicit relations with Pooja and in case she had distanced herself from him, it cannot be construed as an abetment.

He submits that the investigation of the case is complete and final report stands filed On the other hand, learned State counsel assisted by ASI Narinder Singh has opposed the bail application. However, it is not disputed this fact that the victim was previously married and having children. According to him, final report has been filed. Considering the above background and the fact that the trial is likely to take some time, further detention of the petitioner may not be justified. Therefore, without meaning any expression of opinion on the merits of the case, it is ordered that the petitioner be released on regular bail subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of the trial Court concerned.

The petition is allowed.
