As the prayer made in the petition is for restraining the respondents from interfering in peaceful possession of the petitioner on the land in dispute, acquisition pertaining to which, according to the petitioner, has lapsed in view of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short, 2013 Act) in terms of the order passed by this Court on 30.11.2016. The State has filed Special Leave Petition against the aforesaid order.
Be that as it may, as the prayer made is only for restraining the respondents from interfering in peaceful possession of the petitioner on the land in dispute, in our view, writ is not the appropriate remedy as the petitioner can avail of his appropriate PANKAJ KUMAR 2018.08.10 14:31 I attest to the accuracy and integrity of this document
