Learned counsel for respondent No.5 informs the Court that in fact, the aforesaid notice dated 03.07.2025 (Annexure P-9) was only an intimation calling upon the petitioner to vacate the illegal possession over the public property, and that an eviction petition seeking eviction of the petitioner from the property in question, has already been filed before the Court of competent jurisdiction.

At this stage, learned counsel for the petitioner submits that, keeping in view the aforesaid submissions made by learned counsel for respondent No.5, he may be permitted to withdraw the present writ petition with liberty to the petitioner to raise all pleas before the competent authority where the eviction proceedings have been initiated against him. 5.

Keeping in view the aforesaid submissions made by learned counsel for the petitioner, the present writ petition is dismissed as withdrawn with the liberty aforesaid.
