The present petition has been filed for issuance of a writ in the nature of mandamus directing respondents No. 5 and 6 to provide protection to the petitioners at the time of filing of nomination papers for the post of Sarpanch of Village Datta, Tehsil Dharamkot, District Moga. 2.

It has been pointed out that the State Election Commission, Punjab vide its Notification dated 14.07.2025 issued a notice with respect to the election of 90 posts of Sarpanches and 1771 posts of Panches, which had fallen vacant in different districts after conducting the general election of the Gram Panchayat held on 15.10.2024.

The limited prayer made on behalf of the petitioners is that they have not been permitted to participate in the process of election and are also being restrained from filing their nomination papers, which is scheduled for 17.07.2025 i.e. tomorrow. The petitioners want to contest the election of Sarpanch, Village Datta, Tehsil Dharamkot, District Moga. 4.

In light of the above, without expressing any opinion on the merits of the case, the present writ petition stands disposed of with a direction to the Senior Superintendent of Police, Moga to ensure that adequate security is provided to the persons who intend to participate in the process of election and further to ensure that free and fair election takes place in respect to the posts as referred above. 5.
