ASHOK KUMAR VERMA, J. (ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner in case FIR No.112 dated 08.09.2022 registered under Section 61 of the Excise Act, 1914 (Act No.1/1914) at Police Station Boha, District Mansa. Learned counsel for the petitioner submits that the petitioner, who is 77 years old, has been falsely implicated in the present case due to party faction in the village. As the petitioner is an old man, therefore, it is unbelievable that he absconded from the spot at the time of raid by four-five police officials. Allegedly 50 litre lahan was recovered from the spot. The offence is triable by the Judicial Magistrate Ist Class. Petitioner is not involved in any other criminal case. He is always ready and willing to join the investigation.

-2CRM-M-45002 of 2022 Mr. G.S. Sandhu, Deputy Advocate General, Punjab, who is present in Court, accepts notice on behalf of the respondent-State and opposes the present petition for grant of anticipatory bail to the petitioner. I have heard learned counsel for the parties and perused the record.

Keeping in view the facts and circumstances of the case, the present petition for anticipatory bail is allowed and in the event of arrest, the petitioner shall be released on bail subject to furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) of the Cr.P.C.
