IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 8895 of 2018 (O & M) Date of decision: 18.08.2018 Krishan Kumar ....Petitioner(s)
Versus
State of Haryana and another
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. Jatinder Kumar, Advocate, for the petitioner. G.S.SANDHAWALIA, J. (Oral) C.M. No. 12081-CWP of 2018 Application for placing on record Annexures P-6, P-7 and P-7 (colly) is allowed, subject to all just exceptions. The same are taken on record.
CWP No. 8895 of 2018 The present writ petition has been filed for regularization of services of the petitioner as Chowkidar and accordingly issue an appointment letter to the petitioner and pay the entire pending dues. A perusal of the paper book would go on to show that the petitioner's father was working as a Chowkidar in village Mohabbatpur, Tehsil Aadmpur, District Hisar and he expired on 26.01.2014 and after his demise, the petitioner was working as Chowkidar since 10.02.2014 (Annexure P-2). Resultantly, the present writ petition has been filed. In the absence of any appointment letter, the claim as such for regularization and also in the absence of any policy admittedly not relied upon as Annexure is not tenable and maintainable. Faced with this situation, counsel does not press the present writ petition and prays for withdrawal of the same with liberty to avail his alternative remedy in accordance with law.
Ordered accordingly.
