The plaintiff is before this Court impugning the judgments and decrees of both the courts below, whereby the suit filed by him for permanent and prohibitory injunction restraining respondent No.1/defendant No.1 from alienating the suit property, was dismissed. The judgment of the learned lower appellate court is dated 7.11.2011. Ever since the appeal has been filed, the same is being adjourned on request of counsel for the appellant. Today at the first call, the case was got passed over on request of proxy counsel, as the arguing counsel was not available and when the case was taken up second time, no one has appeared for the appellant.

As no arguments on merits are addressed, the appeal is dismissed. For the purpose reference can be made to the judgment of Hon'ble the Supreme Court in Poonam v. Sumit Tanwar, 2010 (4) SCC 460.
