Mr. Ayush Gupta, Advocate for the appellant. Mr. Amit Singh Sethi, Advocate for the respondent. *** $  &'$( &) Both the parties along with their respective counsel are present today. They suffered individual statements in the shape of affidavits during second motion. They have virtually reiterated their original stand that they had agreed to part ways. They have submitted that there was no scope for reconciliation of their matrimonial dispute and as a result of which they have agreed to get divorce by mutual consent.

In terms of the compromise arrived at between them, the husband has paid ₹2,50,000/ towards permanent alimony and other claims to the wife and the wife has received the same. The only girl child, as per the terms of the agreement between the parties, shall be with the husband.

We are of the considered view that both the parties without any influence or coercion have agreed to part ways. There is no SUNIL DEVI 2016.04.12 10:21 I attest to the accuracy and integrity of this document



 ! possibility for them to join together as a husband and wife. Therefore, in terms of the statements suffered by them during first and second motion, a decree of divorce by mutual consent dissolving their marriage is granted.

The appeal is allowed. Accordingly the petition under Section 13B of Hindu Marriage Act, 1955 is allowed. Decree sheet be prepared.

 As the main FAO seeking divorce by mutual consent has already been allowed, the application under Section 24 of the Hindu Marriage Act becomes infructuous and therefore, it stands dismissed as such.
