(ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 244 dated 30.03.2023 registered under Section 346 IPC at Police Station Rohtak City, Rohtak {whereas challan has been presented under Sections 346, 419 and 376(2)(n) IPC}.

Learned counsel for the State has filed custody certificate dated 05.10.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 04 months and 09 days.

After arguing for some time when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
