(ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Yudhbir alias Tinku in a case arising from FIR No.328 dated 06.07.2018 registered under Sections 307, 120-B, 34 IPC and Section 25 of the Arms Act, 1959 at Police Station Beri, District Jhajjar.
Learned counsel for the petitioner contends that petitioner is in long custody since 07.07.2018. All the prosecution witnesses have turned hostile. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. Learned State counsel, on instructions from SI Ram Pal, admitted the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed.
