The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 2 and 3 to issue him passport.

The petitioner vide application dated 13.10.2022 applied for passport. An FIR No. 71 dated 17.07.2016, under Sections 498-A and 406 of IPC came to be registered against the petitioner. The petitioner has filed CRM-M-18967 of 2022 before this Court seeking setting aside of order dated 17.08.2019 whereby JMIC, Malerkotla, has summoned the petitioner as an additional accused. This Court vide order dated 13.05.2022 has stayed the operation of order dated 17.08.2019 whereby petitioner was summoned PARAMJIT KAUR SAINI 2023.10.03 16:49 I attest to the accuracy and authenticity of this order/judgment
CWP No. 18956 of 2023 -2- 2023:PHHC:127543 as additional accused under Section 319 Cr.P.C.. No other case is pending against the petitioner.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner was issued show cause notice to explain his position with respect to pending criminal case. The petitioner may be directed to appear before the passport authority alongwith requisite documents and clarify his position.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, petition stands disposed of with a direction to petitioner to appear before the passport authority on 20.10.2023 alongwith all requisite documents. The passport authority would decide application of the petitioner expeditiously and preferably within six weeks after considering instructions dated 14.03.2023 issued by the Central Government.
