The petitioner seeks grant of regular bail in respect of the aforementioned FIR.

The FIR was lodged at the instance of Gurdhian Singh, a perusal of which would show that it is a case of dispute arising out of apportionment of land amongst brothers. The petitioner Ram Singh is real brother of Gurdhian Singh (complainant).

Today at the very outset, learned counsel for the petitioner submitted that the matter has been amicably resolved amongst the parties being closely related. GEETA RANI 2024.09.05 17:32 I attest to the accuracy and authenticity of this document

At this stage, Mr. Sukhbir Maandi, Advocate has put in appearance on behalf of the complainant and has filed Vakalatnama, which is taken on record. Learned counsel representing the complainant has endorsed the factum of compromise and has stated that he has no objection in case the petitioner is granted bail.

Learned State counsel has, however, feigned ignorance about the compromise but has informed that the petitioner as on date has been behind bars since the last about 2 months and 15 days. It has also been informed that the petitioner otherwise is not involved in any other case.

This Court has considered rival submissions addressed before this Court. 7.

Without commenting anything as regards merits of the case or as regards the veracity of allegations levelled in the FIR, but having regard to the fact that the parties are closely related and have amicably resolved the matter as has been stated by learned counsel representing the petitioner as well as learned counsel representing the complainant, the instant petition is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
