The learned counsel representing the parties are ad idem that during the pendency of the writ petitions, the respondent-State has re-casted the seniority, therefore, all the three writ petitions qua challenge to the seniority list dated 12.02.2009 are rendered infructuous. It is also not in dispute that the seniority list which has been re-casted is also a subject matter of challenge before this Court. The petitioners also challenged the promotion of the private respondents.

Keeping in view the aforesaid facts, all the three writ petitions are disposed of while keeping the issue of correctness of the promotion of the private respondents open. In other words, after the issue of seniority is settled, the petitioners will have the liberty to assail the correctness of the promotion orders of the private respondents.
