1. Through the instant petition, as instituted under Section 482 of the B.N.S.S., 2023, the petitioner seeks the concession of anticipatory bail, in case FIR No.41 dated 29.06.2024, under Sections 406, 420, 465, 467, 468 and 471 of the IPC, registered at P.S. Naya Gaon, District S.A.S. Nagar.

Succinctly stated, the bedrock for registration of the present FIR is constituted by a complaint made by the Executive Officer, Municipal Council, Nayagaon, wherein, he alleged that certain NOCs have been forged by some unknown person by changing the offline/online NOCs. On the basis of this complaint, an inquiry was conducted and thereupon the name of the petitioner cropped up as the person, who forged the NOCs and submitted the same to the office concerned for obtaining electricity meters. In lieu of getting installed electricity meters by preparing fake NOCs, the petitioner is alleged to have received a total sum of Rs.6,40,000/- from different persons.

3. The learned counsel for the petitioner inter alia submits that,

neither the petitioner is involved in any illegal activities, nor he submitted any forged NOCs for the purpose of obtaining electricity connection(s) from PSPCL. He further submits that, neither the petitioner received any money from any person in lieu of getting installed electricity meter, nor he sold any plot/house to any person person, who uses the allegedly forged NOC, while taking electricity connection.

4. The learned counsel for the petitioner further submits that, although the petitioner is involved in four more cases, however, in the present case, the investigating agency is not seized of any cogent material/evidence, thus connecting the petitioner with the alleged crime.

7. In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 482(2) of the B.N.S.S., 2023.
