Affidavits of Harbhajan Kaur and Satinder Singh have been placed on file. Affidavits of Smt. Kaushalya Devi, Tushar Gupta and Nimish Gupta, who are the contesting respondents in the present appeal and original plaintiffs have also been filed. Affidavit of Karnail Singh has also been filed. The application is allowed. The documents are taken on record. R.S.A. After hearing learned counsel for the parties, going through the affidavits and written compromise between the parties, the appeal is accepted. The judgments passed by the Courts below are set aside and Civil Suit No. 240 of 2005 filed on 29.7.2005 decided on 30.9.2010 titled Sadhu Ram (since deceased) represented by LRs versus Karnail Singh, Gurcharan Singh and others, suit for specific performance stands dismissed.
