In this regard, learned counsel for the petitioner states that after three years, the final report has been filed and that offence punishable under Sections 148 and 149 IPC are bailable and maximum punishment prescribed for these offences is one month only. According to learned counsel for the petitioner, challan has not been presented within the period of limitation and, therefore, the same deserves to be quashed. 3.

  to withdraw the petition to seek redressal of his grievance before the learned trial Court to take the plea of bar of limitation and plead that the accused is entitled for discharge.
