*** Ritu Bahri, J. (Oral) The present appeal has been filed against the judgment and decree dated 04.05.2016 passed by the learned Addl. District Judge, Kapurthala, whereby petition filed by the appellant under Section 13 of the Hindu Marriage Act, 1955 for dissolution of marriage, was dismissed. The marriage of the parties was solemnized on 10.02.1994 as per Sikh rites and ceremonies by way of Anand Karaj at village Fatehgarh, Tehsil Bholath, District Kapurthala at Amritsar. Out of the wedlock, two daughters namely Jasmit Kaur and Jaspreet Kaur and son Jasjit Singh were born, who are residing with the appellant. However, due to temperamental difference, the appellant and respondent started residing separately. The appellant filed divorce petition and the same was dismissed. Respondent is present in the Court today and stated that she has no objection if the appellant is granted divorce. She does not want permanent alimony from the appellant.

In view of the above, the instant petition filed under Section 13 of the Hindu Marriage Act is allowed and judgment and decree dated 04.05.2016 passed by the learned Addl. District Judge, Kapurthala is set aside. Divorce is granted to the appellant. Decree sheet be prepared accordingly.
Since the main appeal stands allowed, civil misc. applications, if any, shall also stand disposed of.
