HARSH BUNGER, J. (Oral) Prayer in the present Writ Petition filed under Articles 226/227 of the Constitution of India for issuance of writ in the nature of certiorari for quashing the action of respondent No.3, whereby he has issued directions to respondent No.5 to freeze the account of the petitioner and for setting aside the letter/email dated 02.09.2022 (Annexure P-1) whereby respondent No.5 has frozen the account of petitioner.

In pursuance to order dated 03.08.2023, an affidavit of Shri A. Venkatesh, DANIPS, Deputy Superintendent of Police Cyber Crime Chandigarh has been filed, which reads as under: 1.

That the FIR no. 2 dated 25.06.2022 registered at PS Cyber Crime, UT Chandigarh under sections 419, 420, 120-B HIMANI GUPTA 2023.08.17 16:40 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh

2023:PHHC:104089 CWP-22500-2022 (O&M) -2IPC and all consequential proceedings arising thereto stand quashed vide this Hon'ble Court's order dated 21.07.2023 passed in CRM-M-8437 of 2023, a copy of which is already on record of this Hon'ble Court.

That Respondent no.5 - HDFC Bank Limited has been intimated vide email dated 7.8.2023 about the quashing of the above FIR no. 2 and all consequential proceedings arising thereto as in the said FIR a freeze on the bank account of the Petitioner was directed. The Respondent no.5 has further been informed that the said bank account of the Petitioner is not involved in any other case as per record of this office. Thus, the Petitioner would be free to utilise the bank account as per law and bank policy. Copy of the email dated 7.8.2023 is enclosed for the perusal of this Hon'ble Court.

That the present affidavit is being executed for submission in the Hon'ble Punjab & Haryana High Court at Chandigarh in the CWP No. 22500 of 2022, wherein the next date of hearing is 10.08.2023.

In view of the aforesaid affidavit, learned counsel for the petitioner submits that the present petition has been rendered infructuous and prays that he may be permitted to withdraw the same. 4.

Dismissed as withdrawn.
