Petitioner has impugned order, Annexure P-1 passed by respondent no. 2. According to him, same has not been passed as per law. He relies upon judgment in CWP No. 2550 of 2014 titled as Kuldeep Kaur Chopra & ors. vs. State of Haryana & ors. decided on 16.11.2016. Learned State counsel does not dispute the ratio of the said judgment.

In view of above, impugned order is hereby set-aside. Matter is remitted to same authority for decision afresh after taking into consideration judgment in Kuldeep Kaur's case (supra) expeditiously, in any case not later than three months.
