The present appeal is against the judgment and decree dated 18.11.2015 passed by learned Additional District Judge, Gurdaspur whereby the petition filed by appellant Vinod Kumar under Section 13 of the Hindu Marriage Act for dissolution of marriage was dismissed. 2.
Learned counsel for both the parties state that settlement/agreement dated 28.2.2017 has been arrived at between the parties. In compliance thereto, the petition under Section 13B of the Hindu Marriage Act, 1955 (for short 'the Act') for mutual divorce was filed before the Court of competent jurisdiction at District Judge, Gurdaspur, in which the first motion has already been recorded.

Ordered accordingly. Both the parties shall remain bound by the settlement/agreement. However, liberty is granted to the appellant to file an application for revival of the appeal in case the respondent resiles from the settlement/agreement on the second motion.
