Heard the submission made by learned counsel appearing for the appellant.
The decree of divorce by mutual consent passed by the trial Court under Section 13B of the Hindu Marriage Act, 1955 is under challenge by the wife on the ground of fraud.
Learned counsel appearing for the appellant seeks permission to withdraw the appeal with liberty to file necessary suit before the civil Court challenging the decree on the ground of fraud. Permission is granted. The appeal stands dismissed as withdrawn with liberty as sought for.
